Roads By-law 1 of 2026 & Regulatory Impact Statement

Public comments are invited for the proposed Roads by-law 2026.

The objectives of the By-law are:

  1. Protect Council’s existing infrastructure within the road reservation by informing who is responsible to maintain such infrastructure;
  2. Ensure works undertaken within the road reservation are completed to Council’s standards;
  3. Clarify who is responsible to repair and/or maintain the infrastructure if damaged or altered; and
  4. Protect public safety by ensuring that works undertaken on Council roads are completed in a safe manner.

Potential Impact of the by-law

The by-law regulates activities on roads owned or under the control of Council and where appropriate, permits will be required for activities such as driveway crossovers and storing materials on the road reserve. Permit application fees will apply.

The by-law will provide Council with the power to:

  • Establish standards for works on Council roads to protect infrastructure, public safety and prevent damage to the road;
  • Require driveway crossovers to be constructed to Council standards;
  • Regulate activities that may impact on road infrastructure or vegetation on the road reserve; and
  • Require Council to be notified before commencing works on a road.
